dc.description.abstractEl ordenamiento normativo junto a la jurisprudencia de las altas cortes del Estado colombiano y la práctica judicial permite identificar el acto procesal de acusación como un acto exclusivo de la Fiscalía General de la Nación, inmerso en la Audiencia de acusación. El acto de acusación se caracteriza por estar dividido en dos esferas; En principio desde la presentación escrita con los elementos jurídicos y fácticos que la norma exija. Posteriormente, la lectura formal de estos elementos en la respectiva audiencia pública de Acusación, dando inicio a la etapa de juzgamiento. La propuesta a desarrollar se enmarca en la construcción académica de un ensayo con el fin de otorgarles facultades al juez de conocimiento en relación con la injerencia en el acto de acusación en los fundamentos jurídicos y fácticos presentados por la Fiscalía durante la audiencia de acusación teniendo como referencia los fundamentos jurídicos constitucionales, normativos, jurisprudenciales y los principios que fundamentan el Sistema Procesal Penal Oral y Acusatorio. Si bien la norma en el artículo 339 del C.P.P indica que el escenario para realizar adiciones o correcciones al escrito de acusación es la audiencia de acusación, no se permite modificar los supuestos jurídicos o fácticos que pretende impulsar la Fiscalía generando un desbalance de funciones e imponiendo sin contradicción alguna la modificación de condición del imputado afectando los derechos fundamentales y el bien jurídico colectivo de la correcta y eficaz administración de justicia junto al objetivo del Desarrollo Sostenible de Paz, Justicia e Instituciones sólidas.spa
dc.description.abstractenglishThe normative order, together with the jurisprudence of the high courts of the Colombian State and the judicial practice, allows to identify the procedural act of accusation as an exclusive act of the Office of the Attorney General of the Nation, immersed in the Hearing of accusation. The act of accusation is characterized by being divided into two spheres; In principle from the written presentation with the legal and factual elements that the norm requires. Subsequently, the formal reading of these elements in the respective public hearing of the Accusation, starting the trial stage. The proposal to be developed in the present work is part of the academic construction of an essay in order to grant powers to the judge of knowledge of interference in the act of accusation in the legal and factual grounds presented by the Prosecutor's Office during the accusation hearing having as a reference, the constitutional, normative, jurisprudential legal foundations and the principles that underpin the Oral and Accusatory Criminal Procedure System. Although the rule in article 339 of the CPP indicates that the stage for making additions or corrections to the indictment is at the accusation hearing, it is not allowed to modify the legal or factual assumptions that the Prosecutor's Office intends to promote, generating an imbalance of functions and imposing without any contradiction the modification of the accused's condition affecting the fundamental rights and the collective legal good of the correct and effective administration of justice together with the objective of Sustainable Development of Peace, Justice and solid Institutions.spa
