dc.description.abstractSin duda alguna este trabajo comporta una significativa y trascendental temática. De gran importancia para el derecho en Colombia. Una nación caracterizada por engendrar un sistema jurídico mixto. Que bajo los postulados del Código de Procedimiento Civil, dispone que las partes o sujetos procesales tienen la carga dela prueba y en consecuencia deben arrimar al proceso los elementos de prueba requeridos para acreditar los supuestos de hecho alegados. No obstante, también se le confiere al operador jurídico algunas potestades y poderes constitucionales de instrucción y dirección. Entre las cuales se encuentra la facultad de decretar pruebas de oficio. Tornándose pertinente determinar si esa autoridad no desequilibra el contradictorio de las partes dentro del proceso civil. Por lo que luego de realizar un profundo y exhaustivo análisis constitucional, legal y jurisprudencial. Se logra colegir que indiscutiblemente la potestad del juez no trasgrede el derecho de las partes. Sino por el contrario se convierte en una herramienta idónea y útil al servicio de la justicia. A fin de que los sujetos procesales puedan controvertir y debatir las pruebas oportunamente. Sin que con ello se trasgredan los principios constitucionales al debido proceso, la equidad, igualdad y justicia.spa
dc.description.abstractenglishWithout any doubt this work involves a significant and transcendental theme. Of great importance for the law in Colombia. A nation characterized by engendering a mixed legal system. That under the postulates of the Code of Civil Procedure, it provides that the parties or subjects of the proceedings have the burden of proof and consequently must bring to trial the evidence required to prove the alleged factual assumptions. However, the legal operator is also given some powers and constitutional powers of investigation and direction. These include the power to order evidence ex officio. It becomes relevant to determine whether that authority does not unbalance the adversarial nature of the parties in the civil proceedings. So after conducting a thorough and exhaustive constitutional, legal and jurisprudential analysis. It is possible to conclude that the judge’s power unquestionably does not infringe the rights of the parties. On the contrary, it becomes an appropriate and useful tool in the service of justice. So that the subjects of the proceedings may contest and discuss the evidence in a timely manner. This does not violate the constitutional principles of due process, equity, equality and justice.en
