dc.description.abstractPor medio del presente artículo de reflexión, se pretende hacer un análisis de las instituciones judiciales colombianas, buscando los posibles factores incidentes en las actuales realidades del lento e ineficaz sistema judicial. La metodología para el desarrollo del presente artículo comprende la realización de dos grupos focales realizados en el municipio del Carmen de Viboral y Rionegro Antioquia; como también un recorrido legal, partiendo desde la constitución, en especial los artículos 28, 228 y 229 de los cuales se deriva gran parte de la estructura judicial que compone nuestro sistema. Una vez contrastadas estas instituciones en cuanto al deber ser y lo que son, tendremos un mejor enfoque de lo que pasa en el sistema de justicia colombiano. De igual manera se analizará el acceso a la justicia desde aspectos importantes como son los mecanismos alternativos de solución de conflictos, la infraestructura generada por el estado, los costos que implica acceder a la justicia, el trato de los funcionarios y la falta de conocimiento, la poca facilidad de acceso por la lejanía de algunas personas al sistema de justicia.es_ES
dc.description.abstractenglishThrough this article of reflection, we pretend to make an analysis of the Colombian judicial institutions, looking for the possible incident factors in the current realities of the slow and ineffective judicial system. The methodology for the development of this article includes a legal journey, starting from the constitution, especially the articles 28, 228 and 229 from which much of the judicial structure that makes up our system derives. Once these institutions are contrasted in terms of what should be and what they are, we will have a better approach to what happens in the Colombian justice system. In the same way, access to justice will be analyzed from important aspects such as the alternative mechanisms of conflict resolution, the infrastructure generated by the state, the costs involved in accessing justice, the treatment of officials and the lack of knowledge, the little ease of access due to the distance of some people to the justice system.es_ES
