dc.description.abstract | Colombia es un Estado pluralista que reconoce la coexistencia de diversos órdenes normativos, como el de las comunidades indígenas, que tienen la potestad de administrar su propio sistema de justicia. Sin embargo, se presentan conflictos de competencia con la jurisdicción nacional por no existir un diálogo claro entre ambos sistemas de valores que permitan entender la noción de proceso y justicia en una y otra jurisdicción, situación que ha desfavorecido a las comunidades indígenas que se han visto permeadas por sistemas de justicia y proceso occidentales que no corresponden a su cosmovisión. Este artículo se presenta con el objetivo de caracterizar los principios que rigen la concepción de justicia y la noción de proceso al interior de las comunidades indígenas: Arhuaca, Embera Chamí y Embera Katío a través del análisis de las huellas discursivas que han quedado fijadas en diferentes sentencias en donde se han visto involucradas en alguna situación jurídica. En los tres pueblos indígenas rige la denominada Ley de Origen como mandato superior que orienta la conducta de cada individuo, y la cual busca preservar el orden social y el equilibrio con la naturaleza y la Madre Tierra, por tanto, la justicia y el proceso se aplica no sólo en el terreno material, sino que también está sustentado desde el ámbito espiritual. | spa |

dc.description.abstractenglish | Colombia is a pluralistic State that recognizes the coexistence of various normative orders, such as that of indigenous communities that have the power to administer their own justice system and process. However, there are conflicts of jurisdiction with the national jurisdiction due to the lack of a clear dialogue between both value systems that allow understanding the notion of process and justice in both jurisdictions, a situation that has disadvantaged the indigenous communities because they have seen permeated by Western justice and process systems that do not correspond to their worldview. This article is presented with the objective of characterizing the principles that govern the conception of justice and the notion of process within the indigenous communities: Arhuaca, Embera Chamí and Embera Katío through the analysis of the discursive traces that have been fixed in different sentences where they have been involved in a legal situation. In the three indigenous peoples, the so-called Law of Origin governs as a superior mandate that guides the conduct of each individual, and which seeks to preserve the social order and balance with nature and Mother Earth, for this reason justice and the process are applied not only in the material field but it is also supported from the spiritual realm. | spa |
