dc.description.abstract | Una vez Montesquieu expresó que “una cosa no es justa por el hecho de ser ley. Debe ser ley porque es justa”. Pero entonces, ¿Qué sucede cuando diferentes leyes que predican justicia pretenden prevalecer una sobre otra?, ¿Qué pasa cuando estas versan sobre principios del derecho? Y es que dignidad humana, justicia y libertad, pilares del estado social de derecho, entran a jugar el papel principal en el eterno debate entre la necesidad de imponer una pena tan severa como lo es la prisión perpetua y la obvia necesidad de proteger los derechos de los menores sometidos a conductas degradantes que tendrán que conllevar una sanción ejemplar. Pero habrá que resaltar que se trata de un tema polémico, sin embargo, no uno novedoso. Es que el debate entre aquellos que se muestran a favor de la implementación de dicha pena y aquellos que la condenan trae un recorrido amplio desde que entró a regir la Constitución de 1991, además de una carga política innegable que en reiteradas ocasiones ha prevalecido mucho más que el enfoque jurídico, el cual debería tener mayor peso, e incluso que el enfoque social, que jamás debería dejarse de lado a la hora de pretender introducir en el ordenamiento jurídico una pena, que, como se pretenderá ilustrar en este texto, transgrede postulados del derecho penal moderno y atenta contra la estructura fundamental del estado social de derecho. | spa |

dc.description.abstractenglish | Once Montesquieu expressed that “a thing is not fair because it is law. It must be law because it is fair.” But then, what happens when different laws that preach justice seek to prevail over each other? What happens when they deal with principles of law? And it is that human dignity, justice and freedom, pillars of the social state of law, come to play the leading role in the eternal debate between the need to impose a sentence as severe as life imprisonment and the obvious need to protect human rights of the minors subjected to repugnant conducts that will have to carry an exemplary sanction. But it should be noted that this is a controversial issue, however, not a new one, and the fact is that the debate between those who are in favour of the implementation of said penalty and those who condemn it has come a long way since it entered governing the Political Constitution of 1991, in addition to an undeniable political burden, which on several occasions has prevailed much more than the legal approach that should have greater weight and even than the social approach that should never be left aside when trying to introduce the legal system a penalty, which, as we will try to illustrate in this text, transgresses postulates of modern criminal law and threatens the fundamental structure of the social state of law. | spa |
